A pedestrian is defined as “person who goes or travels on foot; walker.” By definition then, a pedestrian is also a person not riding in a motor vehicle, or car.

As pedestrians walk the streets of our cities, they are forced to cross their busy streets. This routine activity, however, is an inherently dangerous one. We are taught from an early age about the dangers of crossing our streets and roadways: look both ways before crossing, and not to cross in-between.

When a pedestrian and a car (or motor vehicle) collide, the results can be devastating for the pedestrian or the person simply trying to cross the roadway. Each year approximately 4,600 pedestrians are killed as a result of traffic fatalities. Pedestrian fatalities comprise over 10 percent of all traffic fatalities. According to the Federal Highway Commission, a pedestrian is killed in a traffic related accident every 113 minutes and injured in a traffic related accident every 8 minutes. The majority of traffic accidents involving a pedestrian occur in urban areas, at non-intersection locations, in clear weather and at night.

The Federal Highway Administration is working hard to lower the accident rates involving pedestrians. But all agree that the frequency of serious accidents where a pedestrian is hit by a car is still too high.

In New York City alone, a pedestrian is hit by a car approximately 28 times a day; this according to the New York State Department of Motor Vehicles. Each year in New York City, there are over 10,000 pedestrians injured in a traffic accident; and approximately 151 pedestrians are killed in a traffic accident each year in New York City.

There are many circumstances under which a pedestrian can be hit by a car, simply by crossing the street, a hit and run accident, or where a car jumps the curb. Pedestrians are unprotected and when these accidents occur, they are likely to suffer serious injuries or even death.

In New York and New Jersey, when a pedestrian is hit by a car, the injured party is entitled to no-fault benefits that will pay for all reasonable and necessary medical care up to the applicable policy limits.

In addition, the pedestrian injured or killed in a traffic accident, or by being hit by a car, may also be entitled to monetary compensation for pain and suffering and other damages.
