The Village Voice cited a news report on NY1 that 2016 saw an increase in hit and run fatalities among bike riders and pedestrians. The Voice went on to estimate that there may be an underlying reason based on New York statistics. The DWI fines and increased insurance alone make the much lesser fine for leaving the scene of an accident possibly too attractive for those who are impaired at the time of the accident. Their conclusion is speculation, of course, but it does have a certain amount of logic behind it.
Heavier Penalties Instituted for DWI and Distracted Driving Accidents
A look at this year’s statistics for the five boroughs up to and including October shows that while driver fatalities are at 6 those for cyclists and pedestrians total seven. It is more often hard to be involved in a hit and run with another vehicle unless the car is parked. Still, the case for eliminating hit and run fatalities for pedestrians can be made. More stringent penalties are on the books for DWI and there may be additional penalties coming if people continue to text and drive as well.
Cyclists and Motor Cycle Operators Are at Greater Risk
It is always harder for the most attentive driver to always be aware of bike riders and motorcyclists due to the size of those vehicles. Vehicle operators are also more apt to become a victim in a hit and run and, when inattention or drinking are added to the mix, a hit and run may be what the panicked driver chooses.
Any person in the New York City area that has been victimized by a hit and run driver whether as a bike rider, motorcyclist, or automobile operator should be represented in court by an experienced hit and run accident attorney. Injuries that occur especially to pedestrians and cyclists need to be compensated for as rehabilitation and lost wages are costly to the person that has done nothing wrong.
