Hit by an uninsured car
A person was hit by an uninsured car and sustained a serious injury.
The injured person posted the following question:
I came on business visa and recently met with an accident, driver’s … license was suspended and his insurance expired on 9/20/2015. What should I do? Who will take care of all expenses in this case. In police report nothing mentioned w.r.t suspended license and expired insurance. My leg has fractures and require surgery, Please suggest what I should do?
If the injured person was a pedestrian, he/she would be entitled to no-fault benefits through the insurance of the car that hit him. If the injured party was in another vehicle, then that vehicle would be responsible for the no-fault. Otherwise, he/she would be uninsured since MVAIC only affords benefits to U.S. residents.
As far as damages for bodily injury, and assuming the striking vehicle was in fact uninsured, the only recourse would be through insurance for a household vehicle, if any, If not, the hurt person would have to sue the wrongdoer, obtain a judgment and attempt to collect.
