Medical malpractice is the negligence of a doctor, hospital, or other health care provider. Negligence is the failure to use reasonable care under the circumstances, doing something that a reasonably prudent doctor would not do under the circumstances, or failing to do something that a reasonably prudent doctor would do under the circumstances.

To prove a doctor or hospital was negligent, it must be shown by expert opinion that the doctor or hospital deviated or departed from accepted medical or hospital practice.

In New York, a doctor who performs a medical procedure on a patient is obligated to have that reasonable degree of knowledge and skill that is expected of an average doctor who performs that treatment in the medical community in which the doctor practices.
