Sidewalks left with raised or uneven slabs creates a dangerous tripping hazard that can result in serious injury, including fractures of the wrist, elbow, arm, leg, hip, or ankle.
Many times fractures can be treated with a closed reduction – meaning without the necessity of surgery.
Other times, a more significant fracture of a bone that will not heal correctly with casting will require an open reduction and internal fixation. During this procedure, the surgeon will first put the bone back into place and then secure its place with fixation devices such as screws, rod, pins, or plates.
When a trip and fall accident was caused by the commercial property owner’s failure to maintain the public sidewalk in reasonable condition, the landlord may be liable in tort for the injuries and damages caused.
